4. POSTING JOBS
Employers may post job openings on Jobs.com.bn. By posting a job, you represent and warrant that you have the right to offer the job, that the information you provide is accurate and complete, and that the job posting does not violate any applicable laws or regulations.
Job Seekers may submit applications for job openings posted on Jobs.com.bn. By submitting an application, you represent and warrant that you have the necessary qualifications for the job, and that the information you provide is accurate and complete.
6. RECRUITER SERVICES
Recruiters may provide recruitment services to Employers using Jobs.com.bn. By using Jobs.com.bn as a Recruiter, you represent and warrant that you have the necessary qualifications and authority to provide such services, and that you will comply with all applicable laws and regulations.
7. USER CONTENT
Users may submit content, such as job postings, resumes, and other information, to Jobs.com.bn. By submitting such content, you grant Jobs.com.bn a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such content in all formats and distribution channels now known or hereafter devised (including in connection with Jobs.com.bn and its affiliates and partners’ business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.
8. THIRD-PARTY CONTENT
Jobs.com.bn may contain links to third-party websites, applications, or services, which are not under our control. We do not endorse and are not responsible for any content, advertising, products, or other materials on or available from such websites or services.
9. INTELLECTUAL PROPERTY
All intellectual property rights in Jobs.com.bn, including without limitation, copyrights, trademarks, and trade secrets, are the property of Yellow Media or its licensors.
Jobs.com.bn is provided “as is” without warranties of any kind, either express or implied. We do not warrant that Jobs.com.bn will be uninterrupted or error-free, that defects will be corrected, or that Jobs.com.bn or the servers that make it available are free of viruses or other harmful components.
11. LIMITATION OF LIABILITY
In no event shall Yellow Media, its affiliates, or their respective directors, officers, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use or inability to use Jobs.com.bn, whether based on contract, tort, strict liability, or otherwise.
You agree to indemnify and hold harmless Yellow Media, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees and costs, arising out of or in connection with your use of Jobs.com.bn or your violation of these Terms.
We may terminate or suspend your access to Jobs.com.bn at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use Jobs.com.bn will immediately cease.
14. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of Brunei Darussalam, without giving effect to any principles of conflicts of law.
Any dispute, controversy or claim arising out of or relating to these Terms or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of these Terms to arbitrate, shall be determined by arbitration in accordance with the laws of Brunei Darussalam. The seat of arbitration shall be Bandar Seri Begawan, Brunei Darussalam. The language of the arbitration shall be in Malay and/or English.
16. ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and Yellow Media regarding the use of Jobs.com.bn, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Yellow Media with respect to such use.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
The failure of Yellow Media to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
You may not assign or transfer these Terms or your rights and obligations hereunder, without the prior written consent of Yellow Media. Yellow Media may assign or transfer these Terms, in whole or in part, without restriction.
